Terms of Use

These terms of use (hereinafter — the Terms) establish the procedure for using the website autosel.lt (hereinafter — the Platform), operated by UAB „Autosel“, company code 307414544 (hereinafter — the Administration). By registering on the Platform, the User confirms that they have read the Terms and undertake to comply with them.

1. Definitions

1.1. “Platform” — the website autosel.lt and UAB „Autosel“, which operates it.

1.2. “User” — a natural or legal person who has registered on the Platform or uses it.

1.3. “Listing” — information placed by the User on the Platform about a vehicle, tyres or another transport-related item offered for sale.

1.4. “Business Client” — a vehicle dealer or dealership using the Platform for professional activities; a cooperation agreement concluded with the Administration additionally applies to them.

1.5. “Privacy Policy” — the rules on the processing of personal data published at autosel.lt/privacy; it forms an integral part of these Terms.

2. Account and registration

2.1. Natural persons aged 18 or over and legal persons acting through authorised representatives may register on the Platform.

2.2. When registering, the User provides accurate and correct data and updates it when it changes.

2.3. One User may hold one account. The account is personal — transferring login credentials to third parties is prohibited.

2.4. The User is responsible for all actions performed while logged into their account. Upon noticing unauthorised use of the account, the User shall immediately inform the Administration.

2.5. During registration, the User confirms their consent to these Terms and the Privacy Policy. The fact of consent, the document version and the time are recorded in the User's account.

3. Requirements for placing listings

3.1. The information provided in a Listing (price, make, model, year, mileage, condition, photographs) must be accurate, correct and up to date.

3.2. One Listing is intended for one vehicle (or one item). Duplicating the same object in several Listings is prohibited.

3.3. Photographs must depict the advertised object. Using someone else's, misleading or unrelated photographs is prohibited.

3.4. A Listing shall be placed in the category corresponding to it and with the correct location.

3.5. The User must have a lawful basis for advertising the object (ownership title, the owner's authorisation, a brokerage agreement or other).

3.6. Once the vehicle has been sold or has otherwise lost relevance, the User shall promptly update or remove the Listing.

3.7. Listings may be reviewed by the Administration's moderators before publication and during their validity period (see Section 6).

3.8. A Listing is published without an expiry date: once approved it remains displayed on the Platform until the User removes it (marks it as sold, reserves or archives it from their account) or until it is removed by the Administration on the grounds set out in these Rules.

4. Prohibited content

It is prohibited to place on the Platform:

  • information about an object, its price or condition that is untrue or misleading;
  • listings of non-existent objects or objects unlawfully attributed to the User;
  • content related to fraud or attempts to obtain money or data by deception;
  • discriminatory content (on the grounds of sex, race, nationality, religion, disability, sexual orientation or other);
  • political propaganda, extremist or terrorist content, pornography;
  • advertising of illegal goods or services (weapons, drugs and the like);
  • content infringing the intellectual property of third parties (other people's photographs, texts);
  • personal data of third parties without their consent;
  • links to competing listing platforms or content whose sole purpose is to divert traffic elsewhere;
  • any other content that violates the legal acts of the Republic of Lithuania or the EU.

5. Prices and limits

5.1. Standard placement of a Listing on the Platform is currently free of charge for both private individuals and Business Clients.

5.2. Free placement does not mean unlimited listings — limits on simultaneously active listings apply: a private individual — 1 listing; a Business Client (dealer or dealership) without a plan — 3 listings; a dealer with a plan — according to the limit of the selected plan (S — 5, M — 20, L — unlimited). The applicable limits are published on the Platform.

5.3. Additional services (promoting a listing to TOP, highlighting, dealer plans with higher listing limits and monthly credits, advertising and the like) are provided for a fee according to the price list published on the Platform. The price is shown to the User before the service is ordered.

5.4. The Administration reserves the right to introduce a fee for standard listing placement in the future. Private Users shall be informed thereof by email no later than 30 days in advance, and Business Clients — in the manner set out in their agreement (no later than 3 months in advance).

5.5. Fees paid for additional services are non-refundable if the service has already been provided or the listing has been removed due to a violation of the Terms.

5.6. The limits on active listings also apply to listings uploaded to the Platform automatically (e.g. via an XML feed from a system used by a Business Client) — automated upload does not circumvent the limits.

6. Moderation and sanctions

6.1. The Administration has the right to review, edit, move to another category, temporarily suspend or remove a Listing if it does not comply with the Terms or the requirements of legal acts.

6.2. The User is informed of the rejection or removal of a listing by a notification stating: the specific reason (with a reference to the violated provision of the Terms or a legal act), the consequence and the appeal procedure (see Section 8).

6.3. Sanctions are applied proportionately to the violation: warning → removal of the listing → temporary restriction of the account → blocking of the account.

6.4. In the event of a gross or repeated violation (fraud, deliberately misleading information, illegal activity, infringement of third parties' rights), the Administration has the right to immediately, without prior warning, restrict the account or suspend the display of listings, informing the User no later than on the day the action is taken and stating the reasons.

6.5. Removed content is not irrevocably destroyed immediately — it is stored for the periods set out in the Privacy Policy for the purpose of resolving a possible dispute.

6.6. Submitted listings are published automatically within a few minutes unless a moderator rejects them in that time; a previously rejected listing that is resubmitted is published only after a moderator approves it. Decisions restricting content (rejection, removal, suspension) are in all cases made by a human (moderator), including for listings already published.

7. Reporting violations

7.1. Any person may report potentially unlawful content or content violating the Terms: via the “Report” button next to a listing or by email to [email protected].

7.2. It is recommended that the report indicate: a link to the content, the nature of the violation and an explanation. A report submitted by email should also include the reporter's name and surname (or company name) and email address, except where the report concerns content involving sexual offences.

7.3. The Administration examines reports diligently, impartially and in a timely manner, and informs the reporter of the decision taken.

7.4. Systematic submission of manifestly unfounded reports is considered abuse and may result in restriction of the account.

8. Appeals

8.1. A User who disagrees with a decision of the Administration (rejection or removal of a listing, restriction of the account) has the right to submit an objection by email to [email protected] within 14 calendar days of receiving the notification.

8.2. The objection is reviewed by a person who was not involved in making the initial decision, where organisationally feasible. The Administration responds no later than within 15 calendar days.

8.3. The User also has the right to apply to a court or to use out-of-court dispute resolution procedures. More about content moderation — on the transparency page autosel.lt/transparency.

9. Intellectual property

9.1. The Platform's design, software, database and the “autosel.lt” trademark are the exclusive property of the Administration.

9.2. By placing content on the Platform, the User grants the Administration a non-exclusive, royalty-free, worldwide licence to use, reproduce, publicly display, distribute and technically process (including changing the format or size of photographs) this content to the extent necessary to provide the Platform's services and to carry out the Platform's marketing.

9.3. The User confirms that they hold all rights to the content they place and that the content does not infringe the rights of third parties.

9.4. Automated collection (scraping) of the Platform's data or its use in other systems without the Administration's consent is prohibited.

10. Liability

10.1. The Administration is a provider of an intermediation service: it provides the technical means to place and view listings, but is not a party to vehicle sale transactions.

10.2. The User who placed a listing is responsible for the accuracy and lawfulness of its content.

10.3. The Administration is not liable for transactions concluded between Users or with third parties, or for disputes arising from them.

10.4. The Administration strives to ensure uninterrupted operation of the Platform, but does not guarantee that the Platform will operate without disruptions, and is not liable for indirect losses, except where the damage was caused intentionally or through gross negligence.

11. For Business Clients (dealers and dealerships)

11.1. The relationship between Business Clients and the Administration is additionally governed by a cooperation agreement; in the event of a conflict between its provisions and the Terms, the agreement prevails.

11.2. Amendments to the Terms that may affect the activities of Business Clients take effect no earlier than 15 calendar days after notice thereof, in accordance with Regulation (EU) 2019/1150 (P2B). This period does not apply where the amendments are made to comply with legal requirements, are favourable to the Business Client, or are of an editorial nature.

11.3. A Business Client who believes that the Administration is not complying with the agreement or Regulation (EU) 2019/1150 has the right to submit a complaint by email to [email protected]; the Administration responds no later than within 15 calendar days.

11.4. Business Clients must comply with the legal requirements applicable to their activities, including consumer protection and vehicle trade regulation.

12. Personal data

The processing of personal data on the Platform is governed by the Privacy Policy (autosel.lt/privacy). A User who provides third parties' data in a listing or in correspondence must have a lawful basis for doing so.

13. Amendments to the Terms

13.1. The Administration has the right to amend the Terms. Each version is numbered and published together with its effective date.

13.2. Users are informed of material amendments by a notification on the Platform or by email no later than 15 calendar days before they take effect (for Business Clients — in the manner set out in Section 11).

13.3. By continuing to use the Platform after the amendments take effect, the User confirms their agreement to them. A User who disagrees has the right to stop using the Platform and delete their account.

14. Final provisions

14.1. The Terms are governed by the law of the Republic of Lithuania.

14.2. Disputes shall be resolved through negotiations, and failing agreement — in the courts of the Republic of Lithuania in accordance with the procedure established by legal acts.
